EIGHTPASS OFFICIAL RULES

These Official Rules (“Rules”) govern all giveaways, sweepstakes, and prize promotions (each, a “Giveaway”) offered via Eightpass.com and the EightPass platform (“EightPass”, “Sponsor”, “we”, “us”, “our”). By participating in any Giveaway, you agree to be bound by these Rules and the specific details disclosed on the applicable Giveaway page.
 
 
1. Sponsor
 
The Sponsor of each Giveaway is:

2. Eligibility
 
Giveaways are open only to:
 
legal residents of the fifty (50) United States and the District of Columbia,
who are at least eighteen (18) years of age at the time of entry
(nineteen (19) in Alabama and Nebraska; twenty-one (21) in Mississippi).
 
Void where prohibited by law.
 
Employees, officers, directors, contractors, and agents of Sponsor, its parents, affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parents, children, and siblings) and those living in the same household are not eligible to enter or win.
 
Entries generated by script, macro, bot, AI automation, or other mechanical or automated means are void.
 
 
3. Promotion Period
 
Each Giveaway will clearly state its start date/time and end date/time (the “Promotion Period”) on the Giveaway detail page.
All times are Pacific Time (PT) unless otherwise stated.
 
Only entries received by Sponsor’s systems during the Promotion Period are eligible. Sponsor’s database clock is the official timekeeping device for the Giveaway.
 
 
4. How to Enter
 
There are two ways to enter, where permitted by law:
 
 
A. Purchase Method (Coins → Entries)
During the Promotion Period, eligible users may:
 
Purchase Coins on EightPass; and
Redeem Coins for entries into available Giveaways within the EightPass app or website.
 
The number of entries you receive per Coin will be displayed on each Giveaway page. For example:
 
Premium Giveaways (e.g., high-value electronics): typically
1 Coin = 1 Entry
Mini Giveaways (e.g., gift cards): typically
1 Coin = 3 Entries
 
Coins are a virtual balance used solely to obtain entries into eligible Giveaways on EightPass.
Coins are not money, have no cash value, cannot be withdrawn, and cannot be exchanged for cash or credit.
 
Important: A purchase or payment will not increase your chances of winning compared to the free entry method described below.
 
 
B. Alternate Method of Entry (“AMOE”) – No Purchase Necessary
To enter a Giveaway without making a purchase, hand-print the following information on a plain 4” x 6” postcard:
 
your full name
complete mailing address
city, state, and ZIP code
email address
telephone number
date of birth
the exact Giveaway title you are entering
 
Mail the postcard in a stamped envelope to:

[City, State, ZIP]
 
Each properly completed and received postcard will count as one (1) entry into the specified Giveaway.
Limit: one (1) mailed entry per person per day per Giveaway.
 
Postcards must be postmarked on or before the Giveaway end date and received by Sponsor no later than seven (7) days after the end of the Promotion Period for that Giveaway.
 
Sponsor is not responsible for lost, late, misdirected, illegible, damaged, incomplete, or postage-due mail.
Mechanically reproduced entries, bulk mailings, and envelopes containing multiple postcards are void.
 
All eligible entries—whether entered by purchase or by AMOE—have the same chance of winning.
 
 
5. Entry Limits
 
Any entry limits, maximum entries per person, per household, or per Giveaway will be stated on the Giveaway detail page. Sponsor reserves the right to disqualify any person who exceeds stated limits or attempts to circumvent limits by using multiple accounts, identities, or automated methods.
 
 
6. Prizes
 
Each Giveaway’s prize(s) will be described on the Giveaway detail page and may include, for example:
 
consumer electronics (such as smartphones)
gift cards
digital codes
merchandise or other items
 
The Approximate Retail Value (“ARV”) of each prize will be disclosed in the Giveaway details.
Prizes are non-transferable, non-refundable, and may not be redeemed for cash or substituted by the winner.
 
Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion thereof) with a prize of equal or greater ARV if the advertised prize becomes unavailable for any reason.
 
Any costs and expenses associated with prize acceptance and use that are not expressly stated as included (such as internet fees, accessories, or upgrades) are the sole responsibility of the winner. For gift cards, the terms and conditions of the card issuer apply.
 
 
7. Odds of Winning
 
The odds of winning a prize depend entirely on:
 
the total number of eligible entries received for that Giveaway during the Promotion Period.
 
More entries increase your probability of winning but do not guarantee a win.
 
 
8. Winner Selection
 
Within a reasonable time after the end of the Promotion Period (typically within seven (7) days), Sponsor or its designated agent will conduct a random drawing from among all eligible entries received for the Giveaway.
 
Random selection may be performed using a secure, auditable process. Sponsor may maintain internal logs or identifiers (e.g., drawing IDs) for auditing and verification purposes.
 
 
9. Winner Notification & Verification
 
Potential winners will be notified by:
 
email sent to the address associated with their EightPass account or provided via AMOE; and/or
in-app notification or account messaging.
 
Sponsor will make reasonable efforts to contact potential winners within seven (7) days following the drawing.
 
To claim a prize, a potential winner may be required to:
 
respond within three (3) days of notification,
complete and sign an affidavit of eligibility,
provide a liability/publicity release (where permitted by law),
provide a valid government-issued ID, and
for prizes with ARV of $600 or more, complete an IRS Form W-9 (for U.S. taxpayers) and any other required tax forms.
 
If a potential winner:
 
does not respond within the stated time,
fails to provide required documentation,
is found ineligible, or
declines the prize,
 
then Sponsor may, at its sole discretion, disqualify that individual and select an alternate winner from among remaining eligible entries.
 
 
10. Taxes
 
All federal, state, and local taxes, fees, and surcharges associated with prize acceptance are the sole responsibility of the winner.
 
For U.S. residents, Sponsor may be required to issue an IRS Form 1099-MISC for the total ARV of prize(s) awarded to a winner in a calendar year. As a condition of receiving a prize with ARV of $600 or more, the winner must provide a completed and accurate IRS Form W-9.
 
Sponsor does not provide tax, legal, or financial advice. Winners should consult their own tax professionals.
 
 
11. General Conditions
 
By participating, you agree that:
 
You will abide by these Official Rules and all decisions of Sponsor, which are final and binding in all matters related to each Giveaway.
Sponsor reserves the right to cancel, suspend, or modify any Giveaway, or these Rules, if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Giveaway.
Sponsor reserves the right to disqualify any individual who tampers with the entry process or the operation of the Giveaway or website, violates these Rules, or acts in an unsporting or disruptive manner.
In the event of cancellation, Sponsor may, at its discretion, award the prize(s) in a random drawing from among all eligible, non-suspect entries received up to the time of cancellation.
 
To the maximum extent permitted by law, by participating you agree to release and hold harmless Sponsor, its affiliates, and their respective employees, officers, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with participation in the Giveaway or acceptance, use, or misuse of any prize.
 
 
12. Privacy
 
Personal data collected from entrants is used to:
 
operate and administer the Giveaway,
verify eligibility and identity,
communicate with participants and winners, and
comply with legal and tax reporting obligations.

Sponsor may share limited data with trusted third-party vendors solely for prize fulfillment, email delivery, and compliance purposes.
 
 
13. Disclaimers
 
This Giveaway is in no way sponsored, endorsed, or administered by, or associated with:
 
Apple, Amazon, Google, Microsoft, Meta (Facebook / Instagram), TikTok, Sony, or any other third-party brand or platform, unless expressly stated.
 
All trademarks, logos, and brand names are the property of their respective owners.
 
 
14. Governing Law & Disputes
 
These Rules and any disputes arising out of or related to any EightPass Giveaway shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict-of-law principles.
 
Any claims or actions must be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of such courts.
 
 
15. Winners List
 
A list of winners (first name, last initial, and state) may be posted on the EightPass website on a Winners page or made available upon request, where required by law.
